Environment:

TR version 3.1.2
Operating System: Win XP
Java version: (1.6.0_24

1. Overview, Criterion, Energy
2. Customize, add your own, example: Conversational
3. Enable Use this criterion
4. Edit an Action Window so this is selectable filter
5. Select the filter

It does not filter, see attached example

Did you check the box 'Exclude if null' for your energy filter?
